These Terms and Conditions govern the use of the website movecare.ro and its associated platforms (portal.movecare.ro for partners, curse.movecare.ro for driver tracking, and feedback.movecare.ro for beneficiary feedback), as well as your relationship with:
Creative Mobility Solutions SRL, CUI 53014147, Str. Regele Ferdinand nr. 22-26, Cluj-Napoca, Romania, hereinafter referred to as "Move Care".
By accessing the website, creating an account, making an advance payment, or registering as a driver or as a partner organization, you confirm that you have read, understood and accepted these terms in full.
Move Care is a social enterprise that provides:
The cost of social rides is split according to the model displayed on the website (currently: 50% Move Care, 50% the partner organization). The beneficiary pays nothing at the end of the ride.
To make recurring advance payments, accumulate kilometers, or order discounted commercial rides, creating an account is required. By registering, you agree to:
You are responsible for any activity carried out through your account. The first time you use the website, you will be asked for your explicit consent to the processing of personal data and to these Terms and Conditions.
The amounts contributed through the "Give a ride" section are, for tax purposes, advance payments for a future ride, not donations in the classic sense — Move Care is a commercial company (SRL), not an association or foundation. These payments may be made as a one-time contribution or recurrently (monthly) and may be stopped at any time, without penalties.
Invoicing works in two steps: at the time of payment, an advance invoice is automatically issued and sent by email. Once the ride funded by your payment actually takes place, the advance invoice is reversed via a credit note (storno), and Move Care issues the final fiscal invoice, accompanied by details about the ride and our thanks.
The rewards scheme works as follows:
Rides discounted through kilometers are subject to availability and may involve a different waiting time compared to standard commercial rides.
Drivers who wish to be part of the Move Care community must hold:
Collaboration may take one of the following forms:
Financial details (rates, commissions, payment terms) are set out in the individual contract concluded with each partner driver or company.
Relationship with partner drivers. The partner driver acts as an independent professional (an authorized individual, the holder of a company/sole proprietorship, or an employee of a partner fleet), and not as an employee, representative, agent or mandatary of Move Care. No employment relationship, joint venture or partnership arises between Move Care and the partner driver. The partner driver is personally responsible for complying with the legislation applicable to the transport activity (licenses, certificates, insurance, tax obligations) and for their conduct towards beneficiaries and passengers.
Commercial rides through Bolt or Uber. Commercial rides carried out by partner drivers through the Bolt and/or Uber platforms take place exclusively under the Terms and Conditions of those platforms, to which Move Care is not a party. Move Care does not operate, control or take responsibility for the carrying out of these rides, for fare calculation, for the conduct of the driver or passenger, or for any incident occurring during a commercial ride — any complaint relating to a ride carried out through Bolt or Uber must be addressed directly to that platform.
Organizations (NGOs, clinics, institutions) that wish to request social rides must be verified by Move Care and must conclude a partnership agreement. The partner organization is responsible for:
Payments (advance payments for rides, commercial rides, partner contributions) are processed through the authorized payment processor NETOPIA Payments (a service provided by NETOPIA FINANCIAL SERVICES S.A.). Move Care does not store bank card data. An invoice is issued for each payment in accordance with Romanian tax legislation, using integrated invoicing services (Oblio). For advance payments, the advance invoice issued at the time of payment is reversed via a credit note (storno) and replaced with the final fiscal invoice after the corresponding ride is completed.
Making a payment through the NETOPIA Payments platform implies your explicit acceptance, as a payer, of NETOPIA Payments' own Terms and Conditions for Payers (Romanian only), which supplement this document. NETOPIA Payments does not charge the payer any commission for making a payment. For card payments, any payment-related disputes (such as refund requests or a declined transaction) are resolved primarily according to the rules specific to the payment method used (the arbitration rules of the international Visa/Mastercard card schemes).
The Move Care website and services are provided "as is" and "as available". Move Care makes all reasonable efforts to ensure the quality, safety and continuity of its services, but cannot guarantee that they will function uninterrupted, on time, or free of errors.
To the maximum extent permitted by applicable law, Move Care cannot be held liable for:
Nothing in this document is intended to limit or exclude Move Care's liability in cases where the law does not permit this (for example, in the event of fraud or personal injury caused by Move Care's proven fault).
The user, partner driver or partner organization agrees to indemnify and hold harmless Move Care, as well as its representatives and employees, from any claim, damage, cost or expense (including reasonable attorney's fees) arising from: a breach of these Terms and Conditions, a breach of applicable law, or their own act committed in connection with the use of the website or with the provision of/benefiting from transport services.
Move Care is released from liability for the non-performance or delayed performance of any obligation where this is due to an event of force majeure or a fortuitous event (for example: natural disasters, power or internet outages, failures of payment providers or third-party platforms, acts of authorities, strikes, epidemics), in accordance with the provisions of the Romanian Civil Code.

Move Care reserves the right to suspend or close an account in the event of:
In situations that do not involve urgency or obvious fraud, we will notify the user in advance. Any amounts or rights accumulated (for example, Move Care kilometers) relating to an account suspended for breach of these terms may be cancelled.
These terms are governed by Romanian law. Any dispute will be resolved amicably; if this is not possible, the Romanian courts have jurisdiction.
